It is a crime for a person to use, carry, or possess a firearm in the furtherance of a crime of violence or drug trafficking crime. In Bailey v. United States, the Supreme Court held that a conviction for the “use” of a firearm during a crime of violence or drug trafficking crime was dependant upon proof of the active employment of the weapon. For example, possession of a gun in a locked automobile truck or locked footlocker in a closet may not amount to “use.” Also, the 11th Circuit determined that concealing a gun under a mattress in a room next door to the drug trafficking did not constitute “use.”
