In Florida, Murder in the First Degree may arise in three ways:

1. The perpetration of an unlawful killing from a premeditated design;

2. A killing by a person participating in the perpetration of, or attempt to perpetrate, and “enumerated: felony; and

3. The distribution of certain controlled substances, or their preparation by an adult, where the drug proximately causes the death of the user.
