Entrapment involves the inducement of a crime. In Florida, the test for entrapment is a subjective test. The test determines whether the method of inducement created a “substantial risk that such crime would be committed by a person other than one who is ready to commit it.” Fla.Stat. Section 777.201.

However, if the law enforcement officer acted egregiously, the entrapment defense will be reviewed under due process provisions. If governmental conduct is found to violate the defendant’s due process rights, the charges will be dismissed against the defendant.
