Bribery or giving gratuities to individuals employed by the federal government is a federal offense. These statues are found in 18 USC Sections 201 and 666. Section 201 concerns payments to federal officials. Section 666 concerns payments to individuals who are employed by organizations that receive federal money.

Although these are very complex statutes, the legislature’s intent is very clear regarding the subject of bribery. Bribery and the giving of gratuities will be carefully scrutinized and possibly prosecuted. In fact, direct evidence of an agreement is not necessary to prove the bribery or the payment of an unlawful gratuity. It is enough that a private individual occupies a position of public trust and has federal responsibilities. In United States v. Kennedy, a private person was convicted who consulted on an Air Force contract and advised on procurement decisions.

There are numerous cases concerning these violations, and it is clear that the courts look at many different variables when considering whether there is an adequate connection between a bride or gratuity and illegal behavior.
