Embezzlement is a crime of theft. It occurs when there is a fraudulent conversion of the property of another by a person who is already in lawful possession of the property. Embezzlement requires that the accused actually converts the property. This means the owner would be deprived of a significant piece of its usefulness. For example, if the accused just utilizes the property for a short time, this is not embezzlement. Or, if the property is moved for a short time, this is not embezzlement. Embezzlement does not just cover tangible property. Stocks and bonds can be embezzled.
