The following is a copy of the Federal Sentencing Guidelines. This section covers the feloniously mailing of injurious articles.
§2K3.2. Feloniously Mailing Injurious Articles
(a)Base Offense Level (Apply the greater):
(1)If the offense was committed with intent (A) to kill or injure any person, or (B) to injure the mails or other property, apply §2X1.1 (Attempt, Solicitation, or Conspiracy) in respect to the intended offense; or
(2)If death resulted, apply the most analogous offense guideline from Chapter Two, Part A, Subpart 1 (Homicide).
Commentary
Statutory Provisions: 18 U.S.C. § 1716 (felony provisions only).
Background. This guideline applies only to the felony provisions of 18 U.S.C. § 1716. The
Commission has not promulgated a guideline for the misdemeanor provisions of this statute.
