If you are found guilty of a noncapital crime in Florida, you may be released pending the appeal of your case. However, your release will be at the discretion of the trial or appellate court. Nevertheless, you may not be granted bail if you have previously been convicted of a felony and your civil rights have not been restored; or if you have other felony charges pending where probable cause has been established. On the other hand, you may appeal your denial of appellate bail.

Your appeal must be taken in good faith and not frivolous. If you are released, you must agree to:

· Prosecute your appeal;

· Surrender yourself once there is a determination on your appellate appeal;

· Appear and submit to any court orders if a new trial is ordered; and ;

· Stay in the jurisdiction unless given permission of the court.
