In Florida, every arrested person must be taken in front a judicial officer with 24 hours of her arrest. This can be in person or electronic audiovisual means. The public defender and state’s attorney will be given notice of the hearing, and they must appear
(or their assistant may appear). If the accused has an attorney, the public defender need not appear.
The judicial officer must advise the accused of his charges and furnish her a fresh copy of the charges. Also, an official record of the court proceedings must be made. The judge must also advise the accused of her right:
· To remain silent, and anything she says may be used against her;
· To counsel; and
· To communicate with counsel, her family or friends by a means provided by the court.
