Under United States v. Poole, the defendant was convicted of of possession with the intent to distribute drugs when the government proved beyond a reasonable doubt that the defendant knowingly possessed cocaine with the intent to distribute it. This law is found in 21 USC Section 841, et seq.
Additionally, the government may prove constructive possession if it shows that the defendant maintained control or dominion over the drugs or over the premises where the drugs were found.
Also, the government does not have to prove that the defendant had knowledge of a specific drug as long as he knew the drug was a controlled substance.
